This Acceptable Use & Anti-Spam Policy (the Policy) explains what you may and may not do with Banger. It is part of our Terms of Service. It applies to you, everyone in your workspace, and every AI agent, API key, automation, Journey, or integration that acts on your workspace’s behalf.
1. You are responsible for your agents
Banger is built to be operated by AI agents. An agent connected to your workspace through the MCP server or an API key acts for you. Everything it sends, imports, or changes is treated as if you did it yourself, and this Policy applies to it in full.
- Choose which actions need human approval, and review what your agents propose. Banger always asks a person to approve certain actions, such as activating a Journey or publishing shared content. Workspace API keys cannot approve human approvals.
- Do not instruct, prompt, or configure an agent to do anything this Policy prohibits, and do not use agents to get around Banger’s limits or safeguards.
- If an agent misbehaves, pause it or revoke its access. You remain responsible for messages it has already sent.
2. Consent
Send marketing email, including Broadcasts, newsletters, and promotional Journeys, only to people who have given you permission to email them, or where applicable law clearly allows you to email them without it. You must be able to show when and how each person agreed.
Banger helps you keep that record:
- Signup forms use double opt-in by default: new subscribers confirm by email before they are added.
- When you or an agent add a contact as subscribed, through an import, the API, or MCP, you must confirm that you have their consent. Banger records who confirmed it and when, and accepts optional evidence such as the source and the statement the person agreed to.
- Banger will not release a Broadcast to subscribed contacts that have no confirmed consent.
Confirming consent you do not have is a violation of this Policy.
3. Lists you may not use
You may not send to, import, or upload addresses that you:
- bought, rented, borrowed, traded, or received from a list broker or data vendor;
- scraped, harvested, or guessed from websites, directories, social networks, or other sources;
- collected for a different purpose, or under a different brand, without telling people they would get this email; or
- received from an affiliate or third party that cannot show consent for your sending.
Do not re-add people who unsubscribed, complained, or whose addresses hard-bounced, unless they give you fresh consent.
4. Unsubscribes
Every marketing email must let recipients unsubscribe easily and for free.
- What Banger does automatically. Every Broadcast and Journey email Banger sends includes
List-Unsubscribeand one-click unsubscribe (List-Unsubscribe-Post, RFC 8058) headers, and a visible unsubscribe link in the recipient’s language when the email does not already contain one. When someone unsubscribes, Banger immediately suppresses the address for your whole workspace, marks the contact unsubscribed, and stops any sequence it was in. Banger refuses later sends to a suppressed address from any part of your workspace. - What you must do. Do not remove, hide, or break the unsubscribe link, or make people log in, pay, or give more than their email address to leave. If someone asks to unsubscribe by replying or by any other channel, honor the request promptly and in any case within the time the law allows. Under the US CAN-SPAM Act, that is ten business days.
- Product email. Banger treats product email sent from your software, such as receipts, password resets, and account notices, as transactional, and it does not carry a marketing unsubscribe link. Send product email only for genuine transactional or relationship purposes. If an email’s main purpose is promotional, send it as a Broadcast or Journey so it carries an unsubscribe.
5. Identify yourself honestly
- Use accurate From names, addresses, Reply-To addresses, and routing information that identify you or your business.
- Send only from domains and mailboxes you own or are authorized to use. Do not spoof or impersonate another person, brand, or organization.
- Use subject lines that honestly reflect the content of the email.
- Include your company name and a valid postal address in marketing email. Banger requires both in your product’s brand footer before a Broadcast can be released or a Journey with Broadcast steps can be activated.
- Identify an email as an advertisement where the law requires it.
6. Anti-spam and privacy laws
You are responsible for complying with every law that applies to you and to the people you email. Depending on where you and your recipients are, these include:
- United States – CAN-SPAM Act: no false or misleading header information or subject lines, a valid postal address, a clear way to opt out, and opt-outs honored within ten business days.
- European Union and United Kingdom – GDPR, UK GDPR, and ePrivacy/PECR rules: a lawful basis for processing, prior consent for most electronic marketing to individuals, clear information about how you use personal data, and respect for data subject rights.
- Brazil – LGPD: a legal basis for processing, transparency about how personal data is used, and respect for data subject rights, including the right to revoke consent.
- Canada – CASL: express or implied consent before sending commercial electronic messages, identification of the sender with contact information, and an unsubscribe mechanism that is honored within ten business days.
This summary is not legal advice. Local rules differ, and you should get your own advice about your obligations.
7. Prohibited content and uses
You may not use Banger to send, host, or link to:
- phishing, credential harvesting, malware, or links designed to deceive recipients;
- fraud, scams, pyramid or multi-level schemes, or deceptive claims about health, finances, or earnings;
- content that is illegal where you send it or where it is received, or that promotes illegal goods or services;
- child sexual abuse material, or any content that sexualizes minors;
- harassment, threats, hate speech, or content that promotes violence;
- intimate images shared without the subject’s consent;
- content that infringes someone else’s intellectual property, privacy, or publicity rights; or
- unsolicited bulk commercial email.
The following need our written approval before you send them through Banger, and we may pause sending in these categories until we have reviewed it: sexually explicit content; gambling; cryptocurrency, trading, or investment offers; payday or other high-interest lending; debt collection; and automated outreach to people who have not asked to hear from you.
You also may not:
- rotate domains, mailboxes, or workspaces to spread out complaints or avoid suppressions and limits;
- use Banger as an open relay or send on behalf of third parties who are not part of your workspace;
- create workspaces to get around a suspension; or
- probe, test, or send to addresses to check whether they exist.
Banger checks outgoing mail with a spam filter and refuses messages that score as spam-like.
8. Bounces, complaints, and sender reputation
High bounce and complaint rates hurt your deliverability and every other Banger customer’s. Banger acts on them automatically:
- Suppression. When a recipient’s server permanently rejects an address (a hard bounce), or a recipient reports your email as spam, Banger suppresses that address for your whole workspace and refuses later sends to it. Soft bounces, such as a full mailbox, are not suppressed.
- Complaints on person-to-person mail. A single spam complaint about email sent from a mailbox suspends that mailbox.
- Complaints on bulk mail. For Broadcasts and Journeys, Banger suspends the sending mailbox when it receives at least 3 spam complaints and those complaints reach at least 0.3% of the mailbox’s bulk recipients over the previous 24 hours.
- What a suspension means. A suspended mailbox cannot send. A workspace administrator can reactivate it after acknowledging the complaint. Fix the cause first.
- Warnings. Banger alerts you when your bounce rate is above 2% or your complaint rate is above 0.1%, and flags a complaint rate at or above 0.3% or a bounce rate at or above 5% as critical. Major mailbox providers expect bulk senders to keep complaint rates below 0.1% and never reach 0.3%.
- Limits. The Free plan can send up to 100 emails a day. All plans have a monthly sending allowance, described in the Terms of Service.
9. Enforcement
If we believe you or your agents have violated this Policy, or your sending puts recipients, Banger’s infrastructure, or other customers’ deliverability at risk, we may do any of the following, with or without prior notice depending on the urgency and severity:
- refuse or hold individual messages, and suppress addresses;
- pause a Broadcast, Journey, or sending lane;
- suspend a mailbox or sending domain;
- restrict features or lower sending limits;
- suspend the workspace; or
- terminate your account under the Terms of Service.
We will usually tell you what happened and how to fix it. We may report illegal content or activity to the appropriate authorities. Enforcement does not entitle you to a refund except where the Terms of Service or the law require one.
10. Reporting abuse
If you received unwanted email sent through Banger, you can use the unsubscribe link in the email. To report spam, phishing, or other abuse, email hello@team.bangermail.com and include the full message with its headers if you can. We review every report.
11. Changes
We may update this Policy as Banger, the law, or mailbox providers’ requirements change. We will update the date above and, when a change is material, notify workspace administrators before it takes effect.
