These Terms of Service govern your use of Banger: the website at bangermail.com, the web app at app.bangermail.com, the Banger API and MCP server, and related services made available by BangerMail Inc. (Banger, we, us). By creating an account, connecting an agent, or otherwise using Banger, you agree to these Terms, including our Acceptable Use & Anti-Spam Policy and our Privacy Policy.
1. Eligibility and authority
You may use Banger only if you can form a binding agreement and are at least sixteen years old. If you use Banger on behalf of a company or other organization, you confirm that you have authority to bind that organization to these Terms, and “you” includes that organization.
2. The service
Banger is an email system that you and the AI agents you authorize can operate. It covers mailboxes on your domains, product and transactional email sent from your software, broadcasts and journeys to your contacts, contact lists and signup forms, and the setup of the sending domains behind them. You can use Banger through the web app, the API, and the MCP server, and review, approve, edit, or stop what agents do in the web app.
Features change over time. Some features may be labeled beta or preview; they may be less reliable and may change or be removed.
3. Accounts, workspaces, and administrators
- You are responsible for keeping your sign-in methods, API keys, and agent connections secure, and for all activity under your account and workspace.
- A workspace holds your products, domains, mailboxes, contacts, content, settings, and billing. Workspace administrators can add or remove members, connect agents and providers, configure approvals and automations, and access workspace data.
- Tell us promptly at security@team.bangermail.com if you believe your account, an API key, or an agent connection has been compromised.
4. AI agents, API keys, and MCP connections
Banger is designed to be operated by AI agents on your behalf, such as an assistant connected through the Banger MCP server or software using a Banger API key.
- Agents act for you. Anything an agent does with a connection or key you authorized, including drafting, sending, replying, importing contacts, changing domain or DNS settings, or buying a plan, is treated as your action. You are responsible for what your agents send and do, as if you had done it yourself.
- Approvals are your safeguard. Banger lets you require human approval for certain actions. Some actions always require it. You choose how much to review, and you remain responsible for actions you approve and for actions you allow to run without review.
- Keep control of access. You can see and revoke connected agents and API keys at any time. Revoking access stops future actions; it does not undo messages already sent.
- Third-party agents are yours. The AI assistant or software you connect to Banger is provided by you or a third party, not by Banger, and is governed by its own terms. Banger is not responsible for its instructions, errors, or outputs, but the Banger safeguards described in these Terms and the Acceptable Use & Anti-Spam Policy still apply to everything it sends through Banger.
5. Your domains, mailboxes, and connected providers
- You may add only domains and mailboxes you own or are authorized to use. When you ask Banger or an agent to change DNS records or set up sending, you authorize those changes for that domain.
- If you connect a third-party provider, such as a Google account, you must be authorized to do so. You authorize Banger to access the data and perform the actions allowed by the permissions you grant during that provider’s consent flow. You can revoke access at any time from the provider’s own settings, for example your Google account permissions.
- You are responsible for messages sent from your domains and mailboxes through Banger.
6. Your content
As between you and Banger, you keep your rights in the content you submit to or process with Banger, including messages, contacts, templates, and brand assets (Customer Content). You grant Banger the limited rights needed to host, store, process, transmit, and display Customer Content to provide, secure, and support the service.
You represent that you have all rights, permissions, and, where required, consent needed for the Customer Content and contact data you bring to Banger, and for the messages you or your agents send.
7. AI features
Some Banger features use AI models, for example to design emails, suggest labels, triage incoming mail, map imported contacts, or translate content. The providers that power these features, and what they receive, are described in our Privacy Policy. AI output can be incomplete or wrong. Review it before relying on it, especially before it is sent to other people. Banger does not use your Customer Content to train AI models.
8. Acceptable use
Your use of Banger, and your agents’ use, must follow our Acceptable Use & Anti-Spam Policy, which is part of these Terms. In short: send only to people who agreed to hear from you, honor unsubscribes, identify yourself honestly, and do not use Banger for unlawful, deceptive, or harmful email. You also may not:
- attempt to gain unauthorized access to accounts, workspaces, systems, or data;
- interfere with the integrity or performance of Banger, or try to bypass sending limits, approvals, suppression lists, or other safeguards; or
- use Banger in a way that violates applicable law, third-party rights, or the policies of connected providers such as Google.
9. Plans, fees, and billing
9.1 Plans
Banger offers a Free plan and paid plans (currently Starter, Pro, Business, and Scale), plus custom Enterprise agreements. Plans differ in their allowances, such as monthly and daily sending, storage, message history, imports, and support; current plans, prices, and allowances are listed on our pricing page. Prices are per workspace.
9.2 Billing periods and automatic renewal
Paid plans can be billed yearly or month to month. The yearly price is the headline price shown on the pricing page; month-to-month billing costs 20% more. Subscriptions are charged in advance and renew automatically at the end of each billing period for the same period length, at the then-current price, until you cancel.
If your agent pays for a plan from chat, the payment buys a fixed prepaid period of one month or twelve months. A prepaid period does not renew automatically. When it ends, the workspace returns to the Free plan unless you buy more time or subscribe.
9.3 Upgrades, downgrades, and cancellation
- You can upgrade, downgrade, or switch billing periods from the billing portal. Plan changes take effect immediately, and our payment processor calculates a prorated charge or credit for the rest of the current period.
- You can cancel at any time. Cancellation takes effect at the end of the current paid period; you keep the paid plan until then, and the workspace then moves to the Free plan.
- Moving to a plan with smaller allowances may limit what you can send or store. Downgrading does not delete mail already stored in your workspace.
9.4 Payment
Payments are processed by Stripe. By subscribing, you authorize us, through Stripe, to charge your payment method for each billing period and for any other fees you incur. Banger does not store complete payment-card numbers. If a payment fails, Stripe may retry it and you keep your plan while it does; if the subscription is ultimately canceled for non-payment, the workspace moves to the Free plan.
9.5 Additional usage
Plans have no usage-based fees today. When a paid plan reaches its monthly send allowance, further sends are refused until the next billing period or until you upgrade (see section 10). If we introduce usage-based fees, we will tell you in advance, and they will apply only if you choose them.
9.6 Taxes
Prices are shown in US dollars and do not include taxes. You are responsible for any sales, use, value-added, goods-and-services, or similar taxes that apply to your purchase, other than taxes on our income. Where we are required to collect a tax, it will be added to your invoice.
9.7 Refunds
Fees are non-refundable, and we do not provide refunds or credits for partial billing periods, unused allowances, or downgrades, except where required by law or where these Terms say otherwise.
9.8 Price changes
We may change our prices. A price change applies to your subscription from your next renewal after we give you notice. We will email you at least 30 days before a price change applies to you. If you do not agree to a price change, you can cancel before it takes effect.
9.9 The Free plan
The Free plan is free of charge and does not require a payment method. We may change or discontinue the Free plan’s allowances with notice.
10. Plan limits
When you reach a plan limit, Banger slows or stops the extra work and tells you, rather than accepting mail and silently discarding it:
- On the Free plan, a broadcast larger than the daily allowance continues over the following days, and other sends above the daily allowance are refused until the next day with an error that says when sending resumes.
- When a workspace’s monthly sending allowance or storage is used up, further sends through Banger are refused with an error until the next monthly period, until space is freed, or until you upgrade.
- An agent or the web app can offer an upgrade at that point. Nothing is charged unless you, or an agent you authorized, choose to buy.
Allowances are measured as described on the pricing page. We may also slow or pause sending, regardless of plan, to protect deliverability as described in the Acceptable Use & Anti-Spam Policy.
11. Third-party services
Banger relies on third-party services, including email delivery, hosting, storage, payment, and AI providers. Your use of third-party services you connect, such as Google or your own AI assistant, is also governed by their terms and policies.
12. Suspension and termination
We may pause sending, suspend a mailbox or workspace, or terminate your access if we reasonably believe you or your agents violated these Terms or the Acceptable Use & Anti-Spam Policy, created security, deliverability, or legal risk, or failed to pay fees owed. Where practical and lawful, we will tell you why and give you a chance to fix the problem. Enforcement is described in more detail in the Acceptable Use & Anti-Spam Policy.
You may stop using Banger and delete your account at any time. Account deletion and data retention are described in the Privacy Policy. Sections that by their nature should survive termination, including fees owed, disclaimers, and limitation of liability, survive.
13. Disclaimers
To the maximum extent permitted by law, Banger is provided “as is” and “as available.” We do not guarantee uninterrupted availability, delivery to any particular inbox, the accuracy of AI output, or that the service will meet every requirement or operate without error. Uptime commitments, where offered, are set out in a separate written agreement.
14. Limitation of liability
To the maximum extent permitted by law, BangerMail Inc. and its affiliates, service providers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, goodwill, data, or business opportunities, arising from or related to your use of Banger.
To the maximum extent permitted by law, our total liability for all claims relating to Banger is limited to the greater of the amount you paid us for Banger in the twelve months before the event giving rise to the claim, or US$100.
15. Changes to these Terms
We may update these Terms from time to time. If we make a material change, we will update the date on this page and, where appropriate, notify you by email or in the product before the change takes effect. By continuing to use Banger after the updated Terms take effect, you agree to them.
